These Terms and Conditions ("Terms") govern the provision of electrical services ("Services") by AC Electric ("Contractor") to you, the customer ("Client"). Please read these Terms carefully before requesting any Services. By requesting Services, you agree to be bound by these Terms.
1. Scope of Work
- The Client shall provide a detailed description of the desired Services.
- Contractor will provide a written estimate outlining the scope of work, materials, labor costs, and estimated timeline for completion.
- Any changes to the scope of work must be agreed upon in writing by both parties before work commences.
2. Permits and Inspections
- Contractor is responsible for obtaining all necessary permits and scheduling inspections.
- Any delays due to permit approvals or failed inspections are beyond Contractor's control and may affect the project timeline.
3. Client Responsibilities
- Client shall provide clear and unobstructed access to the work area.
- Client shall obtain any necessary permits for alterations to the structure affecting electrical work (e.g., moving walls).
- Client shall be responsible for removing or relocating furniture and belongings as needed to facilitate the work.
- Client shall dispose of any removed electrical materials responsibly.
4. Warranties and Guarantees
- Contractor warrants that all Services will be performed in a professional and workmanlike manner and in accordance with applicable laws and codes, including the National Electrical Code (NEC).
- Contractor's warranty on labor is typically for one year from the completion date.
- Contractor is not responsible for failures of materials or equipment provided by the Client.
- Manufacturer warranties on materials and equipment will apply.
5. Payment Terms
- Payment terms will be outlined in the written estimate.
- Typical payment schedules involve a deposit upon contract signing and progress payments tied to project milestones.
- Final payment is due upon completion of the work and inspection approval.
- Late payments may incur a penalty fee.
6. Liability
- Contractor shall not be liable for any delays caused by unforeseen circumstances, such as material shortages or inclement weather.
- Contractor shall not be liable for damage to existing electrical wiring or components not caused by their negligence.
- The extent of Contractor's liability is limited to the cost of correcting their work.
7. Termination
- Client may terminate the contract for any reason with written notice. Client shall be responsible for payment for all work completed up to the point of termination.
- Contractor may terminate the contract for non-payment, Client-caused delays, or unsafe work conditions.
8. Dispute Resolution
- Any disputes arising from these Terms will be resolved through good faith negotiation.
- If negotiation fails, mediation is encouraged before resorting to litigation.
9. Insurance
- Contractor shall maintain general liability and worker's compensation insurance.
- Client is encouraged to verify insurance coverage before work begins.
10. Entire Agreement
- These Terms constitute the entire agreement between Contractor and Client regarding the Services and supersede any prior or contemporaneous communications or agreements.
11. Governing Law
- These Terms shall be governed by and construed in accordance with the laws of the State of illinois
12. Severability
- If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect
